In these Terms, certain words have specific meanings, as follows:
“Kirtan4u.com” / “we” / “us” / “our” means Kirtan4u and its support team.

Acceptance of Terms

By accessing the contents of Kirtan4u you agree to be bound by the terms and conditions set out herein. If you object to any of the terms and conditions set out in this agreement you should not use any of the products or services on Kirtan4u and leave immediately.

  • You agree that you shall not use Kirtan4u for illegal purposes and will respect all applicable laws and regulations. You agree not to use Kirtan4u in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of Kirtan4u. You also agree not to compromise the security of Kirtan4u or attempt to gain access to secured areas or sensitive information.
  • Events are not the responsibility of Kirtan4u. Kirtan4u does not organise events and has no responsibility whatsoever for any loss or damage of any kind suffered at or in connection with any event (including loss, damage or theft any personal property at an event).
  • Please note that dates and times published of events are subject to change without notification.
  • Decisions to change or cancel events are the sole responsibility of the event organiser and or performer. Kirtan4u cannot guarantee to inform you of any change or cancellation of any event or be held responsible for refunds or for any resulting costs you may incur for personal arrangements including travel, accommodation, any other related goods or service or other compensation.
  • Best effort is made to ensure accuracy of GPS Coordinates of Gurdwaras and any other venue, however Kirtan4u cannot take any responsibility for any damage or loss suffered as a result of a misdirection.
  • Kirtan4u cannot be liable in any way for the acts or omissions of others (including event organisers, performers or venue operators).
  • Views expressed by any performer, organiser, attendee, speaker, exhibitor or sponsor at the event are their own. Kirtan4u shall have no liability for advice given, or views expressed, by any performer, organiser, attendee, speaker, exhibitor or sponsor at the event or in any material provided to attendees.
  • Kirtan4u may contain hyperlinks to websites operated by other parties. We do not control such websites and we take no responsibility for, and will not incur any liability in respect of, their content. Our inclusion of hyperlinks to such websites does not imply any endorsement of views, statements or information contained in such websites.
  • All intellectual property of Kirtan4u such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of Kirtan4u remain the property of Kirtan4u.

GENERAL CONDITIONS

  • We reserve the right to modify or cease Kirtan4u for any reason, without notice at any time.
  • We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via email. What constitutes a “material change” will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.
  • We reserve the right to refuse service to anyone for any reason at any time without having to give a reason.
  • We reserve the right to terminate any account without having to give a reason. This includes accounts that may become inactive, violates trademark, or may mislead other users.

CHOICE OF LAW

This Agreement shall be governed by the laws in force in the United Kingdom. The offer and acceptance of this contract is deemed to have occurred within the United Kingdom.

FORUM OF DISPUTE

1. In case of any dispute between you and us, you agree that the proper forum to bring such dispute will be in a court in the United Kingdom.

2. If you bring a dispute in a manner other than in accordance with this section, you agree that we may move to have it dismissed, and that you will be responsible for our reasonable attorneys’ fees, court costs, and disbursements in doing so.

3. You agree that in the event of a dispute arising from or relating to this Agreement or our provision of services to you, the unsuccessful party will be responsible for reimbursing the successful party’s reasonable attorneys’ fees, costs, and disbursements in relation to the dispute.

FORCE MAGEURE

You agree that we are not responsible to you for anything that we may otherwise be responsible for, if it is the result of events beyond our control, including, but not limited to, acts of God, war, invasions, insurrection, riots, terrorism, crime, labour shortages (including lawful and unlawful strikes), embargoes, postal disruption, communication disruption, failure or shortage of infrastructure, shortage of materials, or any other event beyond our control.

SEVERABILITY

1. In the event that a provision of this Agreement is found to be unlawful, conflicting with another provision of the Agreement, or otherwise unenforceable, the Agreement will remain in force as though it had been entered into without that unenforceable provision being included in it.

2. If two or more provisions of this Agreement are deemed to conflict with each other’s operation, we shall have the sole right to elect which provision remains in force.

NON-WAIVER

We reserve all rights permitted to us under this Agreement as well as under the provisions of any applicable law. Our non-enforcement of any particular provision or provisions of this Agreement or the any applicable law should not be construed as our waiver of the right to enforce that same provision under the same or different circumstances at any time in the future.
